As you know, with Empire memberships you have open access to
numerous courses at NO CHARGE. While this is an extremely cost effective, beneficial program
for our attendees it presents certain challenges for Empire if such courses are not
attended, since we still have to prepare and pay for the full attendance of said courses.
In
order to address this issue and ensure efficient resource allocation, we kindly request your
cooperation. Previously, we have made efforts to remind members via email, text, and phone
calls, asking for a three-day advance notice if you are unable to attend a course. By
promptly informing our team, we can avoid unnecessary expenses such as additional
instructors, medications, and certain supplies to accommodate a larger group. This will
enable us to maintain cost control and ensure the affordability of our Membership programs
for others.
Regrettably, the previous notification methods have proven ineffective in
obtaining timely responses from our members. Therefore, we find it necessary to implement a
“no show” fee, a practice commonly used in membership programs similar to ours. However, we
want to emphasize that if you provide us with a notification at least three (3) days in
advance, there will be no fee to pay! We believe this policy is fair and reasonable, as it
allows us to manage our resources efficiently while still providing flexibility to our
members.
To signify your consent and understanding of this policy, please read the terms
outlined below and kindly sign the document.

this matter and look forward to continuing to serve you through our exceptional membership
program.
This shall serve as an acknowledgment between Empire Medical Training (“the
Company”) and yourself, regarding the imposition of a no-show fee for any in-person Company
course for which you have registered and subsequently fail to attend. By signing below, you
acknowledge that you have read and understood the terms outlined in this acknowledgement and
agree to be bound by same.
No-Show Fee: Empire Membership holders shall be charged a no-show
fee, in the amount of $200 for in-person courses and $75 for virtual courses, for each
Company course for which you register and subsequently do not attend, without prior
notification to the Company. To avoid being charged a no-show fee, you must provide the
Company with a minimum of 72 hours’ notice, prior to the date of such Company course (the
first date of such course, where a multi-day event), of your inability to attend the
scheduled course. Such notification must be made in writing, either by email or certified
mail, addressed to the Company’s designated contact person for course cancellations.
Payment
Obligation: You agree to pay any applicable no-show fee within 14 days of
receiving an
invoice from the Company for such no-show fee. Failure to make timely payment may result in
additional penalties, including the suspension of your ability to enroll in future courses
offered by the Company, until such time as the no-show fee has been paid.
Modification or
Cancellation of Courses: You hereby acknowledge and agree that the Company reserves the
right to modify or cancel scheduled courses for any reason. In the event of a modification
or cancellation, the Company will make reasonable efforts to provide notice to registered
participants in a timely manner. In such cases, no-show fees will not be applicable and will
not be charged to participants who were scheduled for the affected course(s).
Credit Card
Authorization: By signing this acknowledgement, you authorize the Company to
charge the
credit provided by you for the Company, to cover any applicable no-show fees. You
acknowledge and agree that the Company will securely hold your credit card information on
file for the purpose of processing payments for no-show fees in accordance with this
acknowledgement.
Liability: While the Company will take reasonable precautions to protect
your credit card information, in no event, shall it be held liable for any unauthorized
access or use of your credit card information. You agree to indemnify and hold the Company
harmless from any claims, damages, or losses arising out of or related to the Company’s
storage and use of your credit card information.
